Potholes are everywhere! This year the roads are filled with them and we find ourselves swerving all over the road trying to avoid them.
However, avoiding every pothole is easier said than done and many of them have the potential to cause serious damage to your car. In addition, it’s not a good idea to swerve all over the road when you are in traffic. Plus, many are filled with water disguising themselves as a puddle and we don’t even see it.
Are you responsible for the damage that a pothole does to your car?
Of course, you have to fix your car to keep it in a safe operating condition. However, you could be reimbursed for up to $300 to cover the cost of repairs. This depends on whether it was a state or city road. If it is a state road you can file a claim with the Rhode Island Department of Transportation (RIDOT).
If it is a city street you can file a claim with the city or town. Some will provide reimbursement, if your claim is approved.
If the damage is severe enough you can even file an insurance claim, although that may show up on your record as an at fault accident. In addition, your recovery will only be for that part of the damages that exceed your deductible.
